mapeer - terms of use

Article 1. Observance of Terms of Use

Mapeer Terms of Use (hereinafter, the"terms") apply to all users of the mapeer website, including the web site of "mapeer.com" domain and the sub domain name which KingFish Communication, Inc (hereinafter the "Kingfish" ) owns or manages. Kingfish considers all users agree and follow to this terms, copyright policy , and privacy policy to use the service of mapeer. Also, the particular web site service for your use of the added separate clauses constitute part of the terms.

Article2. Object and Range

The object of mapeer is to provide the opportunity and environment of compilation, collection and sharing of the map information to the users.
Kingfish can add modify or new service without notifying to the users in advance.

Article 3. User's Registration

You enter the truth and accurate data regarding yourself in user's registration form for the concerning service which user's registration is necessary. Also, you maintain that the register data always reflects the truth and accurate information regarding yourself . If you violate description above or Kingfish judges the truth and accurate information are not registered, Kingfish possesses right to delete your ID and refuse you to use mapeer over future. Furthermore, Kingfish possesses the right to delete IDs of the account which are not used over fixed period.

Article 4. Management of ID and Password

You keep your ID and password on your own responsibility. Kingfish considers the responsibility of the behavior which was done by using the ID and password is responsibility of the user which possesses that ID. When your own ID are utilized in the third party without your permission, or when ID and the password leak to the third party, please communicate to kingfish at once. In addition, when you stop using mapeer temporarily, please do logout every time. Kingfish does not guarantee you altogether the damage which occurs from the leakage and illegal use of your ID and the password that originates in ignoring this article.

Article 5. Prohibition

Kingfish prohibits that the users do the behavior below.

Publishing or disclosing or sending to others via mapeer that those which violate the law or those which is possible. (Infringement of right of the third party, damage of reputation, infringement of privacy, aspersions, slander and threat, the obscenity vulgarity, and so on)
Behavior which harms the minority.
Behavior which opposes to public order and morals.
Disguising your name or impersonating the others
Hiding the origin of the content which is transmitted via the service of mapeer or reorganizing mapeer content such as header and so on, in order to disguise.
With respect to law, uploading or transmitting the contents which have not possessed right.
Uploading or transmitting the advertisement for commerce, the contents for advertisement as purpose or inducement as purpose other than the expedient that Kingfish specifies and explicitly accepts.
Uploading or transmitting computer virus, computer code, files and contents that were designed to disturb, to destroy and to restrict the software of the computer, function of the hardware and the communication equipment.
Behavior which exerts the bad influence to the other users operation.
Behavior which disturbs or confuses the servers or the network which mapeer is connected and which does not follow the stipulation for working condition of network and operating procedures.
Behavior which does the harassment for the third party regardless of the circumstance of method.
Behavior which collects, accumulates or publishes the private information of the third party.
Using mapeer in commercial purpose without the acceptance by the advance document of Kingfish.

Article 6. Correspondence to Violation

Kingfish does not inspect the contents which the users updates or posts in advance. However, Kingfish possesses the right to delete the contents which is updated or posted to mapeer and to modify the publication place when Kingfish judges it is necessary. Our deletion right includes the right to delete the contents which violate this terms or the contents which Kingfish judges that there is a problem. Furthermore, Kingfish possesses the right to delete user ID, password, account, the contents that the users updated or posted and to prohibit the users to use mapeer when Kingfish judges it is necessary. This right of Kingfish can be used with our own discretion other than when the users violate to the contents or gist of this terms.

Article 7. Disclaimer

Users are responsible for the contents that they disclose and publish to others in mapeer. Kingfish does not take responsibility behalf of the users in any way. In addition, Kingfish does not guarantee the reliability, credibility and legality of the contents that users disclose and publish to others in mapeer.
You agree with using contents with your own judgement by your own responsibility and the burden of risk in doing that.
Kingfish retains the contents and contents information and can disclose (1)When there is the request which follows the law, (2)When it is necessary for legal procedure, (3)When it is necessary in order for you to observe this terms, (4)When it is necessary because it corresponds to the claim for the contents which infringe the right of the third party, (5)When it is necessary to protect the safety and common good of property, right, life, body, business of Kingfish or the users.
You understand there is the possibility that (1)the data and the signal from mapeer go through various networks in the process of transmission, (2)the data and the signal which are necessary in order to connect network equipments and materials you connect with are modified. Kingfish is not responsible altogether to delete (1)communication contents such as email and notice of user,(2)contents which published by the users in mapeer.
You agree with that transaction with the advertisers who do the advertisement (prize advertisement is included) in mapeer is done in the responsibility of users and the particular advertisers. Kingfish does not have responsibility altogether concerning the damage which originates in the advertisement itself or which originates in the transaction with the users and the particular advertisers.
There are links to the web sites of the third parties whom Kingfish does not own or manage are included in mapeer. Kingfish does not have responsibility altogether concerning the contents of the web site, privacy policy and management of the third parties.

Article 8. Contents which were transmitted to mapeer

Mapeer has contents compilation function or contents contribution function that the service where the users can transmit the contents and the service where general public can access or revision the transmitted contents. When the users transmitted the contents to mapeer, users permit to Kingfish the right (includes sub license right) of gratuitous non monopolistically uses (includes duplication, release, transmission, distribution, transfer, loan, translation and adaptation) of those contents in Japan and overseas. In addition, the users do not wield moral right.
Kingfish releases portion of right (permitted above) to the users inside mapeer use only when it conforms to the license of Creative Commons which Kingfish appoints. Article 9. Respect of Right of Third Party

The property right regarding the aggregate of the individual data, contents and software which are included in the advertisement inside mapeer or mapeer itself belongs to Kingfish and the third parties who offer the contents to mapeer. These are protected by the Copyright Act, trade mark method and design method etc. You respect these rights and endeavor in order to follow.

Article 10. Privacy Policy

Information of user's registration and the user information which Kingfish received follow to the privacy policy of Kingfish. Please confirm Privacy Policy for more information.

Article 11. Limitation of Liability

Kingfish does not have responsibility altogether concerning the links to other web sites or resource that users posted in mapeer. Kingfish does not have responsibility altogether concerning the contents, advertisement, commodity and service of the other web sites.
You agree with that you solve by your own cost and responsibility if you have claims and litigation that are originated or related to the infringement of rights of the third party or violation of this terms.
You agree with that Kingfish does not owe reparations obligation in the cases below. However, heavily mistake and that is originated intention of Kingfish is excluded.

To use the service or not to use the service
Trouble and bug of the software which is offered are corrected
Cost was required in order to make service substitute, exchanging the commodity which you procured information and any transaction via mapeer
Illegal access or illegitimate alteration to the data
Statement, transmission and behavior of the third party in mapeer
Offer of service became impossible with natural disaster, accident, incident, war, the disturbance, the riot, and labor dispute etc
All other damages that are originated or related to mapeer

Article 12. Modification

You agree with that Kingfish can (1)reform stipulations, (2)modify the contents of mapeer, (3)stop or the discontinuance without notification to the users when Kingfish judges it is necessary. You confirm latest version of the terms when you use mapeer. Kingfish considers that you agree with the revised terms if you use mapeer after revision.

Article 13. Applicable Law

Applicable law of this terms is the Japanese law. Tokyo district court is designated as the first trial exclusive jurisdiction courthouse concerning the dispute.

Article 14. Effect of this terms

This terms of use takes effect from 2008 January 31st.
